The Rest of 2026: Angus Walker’s View
There’s a lot happening in Biodiversity Net Gain before the end of 2026.
So we asked Angus Walker, Partner at TLT LLP, what he thinks the BNG market could look like by January 2027.
Angus knows this area particularly well. He’s a leading adviser on Development Consent Orders for Nationally Significant Infrastructure Projects (NSIPs), has twice chaired the National Infrastructure Planning Association, and specialises in the legal side of Biodiversity Net Gain.
His big prediction? Demand for off-site BNG units could start growing faster than supply.
For developers looking to buy BNG units, a tighter market could mean less choice and more pressure on BNG unit prices.
NSIPs are the other big change coming.
From 2 November 2026, Biodiversity Net Gain requirements will apply to NSIP applications in England, with projects required to deliver at least 10% BNG.
Angus expects that to add demand (although perhaps not quite as dramatically as some are predicting).
There’s more to watch too.
Possible changes to the Biodiversity Net Gain metric are one. Angus is also watching how NSIP applicants deal with the new “BNG Boundary” and the “realistic worst-case” approach to limits of deviation.
But what is he most interested in?
Seeing the first NSIP applications come through under mandatory BNG.
Those early projects should give the industry a clearer picture of how Biodiversity Net Gain works when applied to some of the country’s biggest infrastructure schemes.
And that should tell us plenty about where the BNG market is heading next.
